ASSUMPTION
Officials of the following Departments/Divisions assume that this proposal
would have no fiscal impact to their agencies/offices: Labor and Industrial
Relations (all divisions except Division of Employment Security); Mental
Health; Governor; Elementary and Secondary Education; Agriculture; Public
Safety; State Courts Administrator; Economic Development; Conservation;
Health; Insurance; Gaming Commission; Lt. Governor; Office of the State
Treasurer; Secretary of State; House of Representatives; Prosecution
Services; Revenue; Attorney General; Lottery Commission; Tax Commission; and
State Auditor.
Officials of the Department of Labor and Industrial Relations - Employment
Security (ES) stated that their division has one known employee who could
potentially be subjected to this proposal. ES staff assume that the Division
might not be in a position to have the duties of the subject employee(s)
absorbed by other staff which would necessitate hiring temporary replacement
personnel. ES's Financial Management Section reports the annual salary rate
and benefits of a combination ES/UI position is estimated to be $34,381 and
$10,314 respectively. ES officials assumed that three positions could be
affected and each of those three positions would use fifteen days per year
for the activity. Based on this, during the first year ES officials
estimated that their division could potentially sustain a $7,735 or less
negative impact on the Administrative Fund from Federal Funding.
Officials of the Missouri Department of Transportation (MoDOT) stated that it
would be difficult to estimate a total cost of this proposal. However, the
average MoDOT per month salary is $2,500 x 15 work day limit / average of 21
work days per month = $1,875 per year per employee, assuming 15 days of leave
per year.
Officials of the Department of Corrections (DOC) stated that there was no way
to estimate the number of persons that could be involved in this type of
occurrence or the amount of administrative leave and salary disbursement
borne by the DOC. The possibility would also exist that temporary help could
be hired in the absence of the employee in order to maintain the status quo.
DOC officials assume passage of this proposal would result in minimal fiscal
impact to their agency.
Officials of the Department of Natural Resources estimated no additional
fiscal or workload impact from this proposal as similar programs (i.e.
military leave, Red Cross volunteer programs) are currently in existence.
Oversight assumes that this proposal would grant up to fifteen days of leave
in any state fiscal year to members of the civil air patrol who were
certified to fly counter narcotics missions. However, for purposes of this
fiscal note, Oversight assumes that duties could be reprioritized in such a
way that costs for temporary replacements employees would not be incurred.
Officials of the Office of Administration - Division of Personnel (COA)
assume that the average state employee's salary is $27,019 per year, which
would cost $1,559 for fifteen work days per year. The average fringe benefit
cost is 33% ($520) for a total payroll cost of $2,079 per employee. There
are currently about 450 people in the patrol and the Civil Air Patrol advised
COA officials that an estimated 12 employees are currently working for the
State of Missouri. COA officials assume that 12 employees would take this
leave annually per year the cost would be $19,904 in FY98, $25,628 in FY99
and $26,397 in FY2000.
Oversight assumes that not every employee who was a member of the Civil Air
Patrol certified to fly counter narcotics missions would actually participate
in such missions. It is also probable that not every employee eligible for
the leave proposed in this legislation would take the full fifteen working
days annually. Because the affected employees are currently State employees
and because this proposal would not assign any new/additional duties to the
State of Missouri, Oversight assumes this proposal would have no fiscal
impact, but could create a temporary backlog of work being performed.

FISCAL IMPACT - Small Business
No direct fiscal impact to small businesses would be expected as a result of
this proposal.
DESCRIPTION
This proposal would allow the state of Missouri to grant leave of absence to
any state employee who was a member of the civil air patrol and was certified
to fly counter narcotics missions except members of the Missouri National
Guard. Leave for flying counter narcotics missions would not exceed 15
working days per fiscal year. State employees would not forfeit salary or
benefits while on a counter narcotics mission and would not be discharged
from state employment due to service in the civil air patrol. The Attorney
General would be required to enforce these employee rights. The employee
would be required to give evidence of a counter narcotics mission and provide
his or her immediate supervisor with a Drug Enforcement Agency/Civil Air
Patrol mission number.
This legislation is not federally mandated, would not duplicate any other
program and would not require additional capital improvements or rental
space.
