                              FISCAL ANALYSIS

ASSUMPTION

Officials from the Monroe County Clerk's office assume no fiscal impact.

Officials from the Missouri Ethics Commission (MEC) assume no fiscal impact.

Officials from the Office of the Secretary of State (SOS) stated they could
not estimate or predict fiscal impact of the proposed changes in a given
year. This proposal addresses rare events such as death of an incumbent. If
such an event occurred shortly after certification, there could be additional
cost in ballot preparation. If certain events occurred close to election
day, this proposal would provide significant savings to state and local
governments because this proposal provides that the ballot cannot be changed
any later than 4 weeks before the election. Currently, such changes would be
required up to 9:00 a.m. the Friday before the election.

Oversight for the purposes of this fiscal note will show fiscal impact to be
either unknown savings to (unknown) costs. Fiscal impact is indeterminable
and would be dependent upon the timing of unpredictable events. Fiscal
impact could affect state or local election authorities.

Fiscal impact could be realized prior to any Primary or General election.

this proposal.

DESCRIPTION

This act would address the issue of what happens when a candidate for office
withdraws or dies.

Provisions are made in the event a candidate who is an incumbent or the only
candidate dies or withdraws. Before the 8th Tuesday prior to the primary,
new candidates may file. After the 8th Tuesday before the primary, a vacancy
exists on the general election ballot (filled by party nominating committee).

There are other provisions and time periods which address when a party
nominating committee may select a party candidate for nomination to an office
on the primary ballot.

This act makes other changes, which includes allowing a candidate to withdraw
after the certification date for office, up to the 6th Tuesday before the
election, if the candidate agrees to pay for additional ballot printing
costs.

This legislation is not federally mandated, would not duplicate any other
program and would not require additional capital improvements or rental
space.
