COMMITTEE ACTION: Voted "do pass by consent" by the Committee
on Workers' Compensation and Employment Security by a vote of 14
to 0.
This bill exempts from workers' compensation law any community
service work performed as a condition of probation.
FISCAL NOTE: No impact on state funds.
PROPONENTS: Supporters say that community service work is done
primarily for non-profit organizations, most of which cannot
bear the financial burden of workers' compensation insurance.
So these organizations must seek a waiver of workers'
compensation liability from the worker. Many organizations,
however, refuse to accept community service workers because of
concerns that the organization could still be hit with workers'
compensation liability. This bill eliminates that concern.
Testifying for the bill were Representative McBride; and Bob
Smittincamp, Director of Community Service Work Program.
OPPONENTS: There was no opposition voiced to the committee.
