HCS HB 87 & 264 -- COUNTY BUILDING CODES (Kreider) This substitute allows counties of the third classification to adopt and enforce building codes. The county commission may appoint a building commission to develop and propose building and electrical codes. The county commission may, after public hearing, vote to adopt a proposed code and will submit the question to the voters at the next county-wide primary or general election. Alternatively, the voters of any county may present an initiative petition signed by at least 10% of registered voters to place the question on the ballot at the next general election. FISCAL NOTE: No impact on state funds.
HCS HB 87 & 264 -- COUNTY BUILDING CODES CO-SPONSORS: McLuckie (Kreider) COMMITTEE ACTION: Voted "do pass" by the Committee on Consumer Protection by a vote of 14 to 0. This substitute allows counties of the third classification to adopt and enforce building codes. The county commission may appoint a building commission to develop and propose building and electrical codes. The county commission may, after public hearing, vote to adopt a proposed code and will submit the question to the voters at the next county-wide primary or general election. Alternatively, the voters of any county may present an initiative petition signed by at least 10% of registered voters to place the question on the ballot at the next general election. FISCAL NOTE: No impact on state funds. PROPONENTS: Supporters say that this substitute gives third class counties the option of adopting building and electrical codes. They also say that an absence of codes allows builders to construct dangerous structures or structures of poor quality. Testifying for the bill were Representative Kreider; Missouri Society of Professional Engineers; Consulting Engineers Council of Missouri; St. Louis Area Contractors; American Institute of Architects of Missouri; Fire Marshal Association of Missouri; Homeowners Against Deficient Dwellings; and Missouri Committee for Model Codes. HB 87 -- County Building Codes Sponsor: Kreider This bill allows counties of the third classification to adopt and enforce a building code. The county commission of such counties may appoint a building commission to develop and propose a building and electrical code of regulations for the county. The county commission may, after a public hearing, then vote to put on the ballot at the next county-wide primary or general election the question of adopting the proposed building and electrical code. In addition, the same question may be placed on the ballot via initiative petition by obtaining a minimum of 10% of the registered voters' signatures that voted in the last gubernatorial election.
