HB 88 -- TAKINGS ANALYSIS CO-SPONSORS: Smith, Relford COMMITTEE ACTION: Voted "do pass by consent" by the Committee on Civil and Administrative Law by a vote of 16 to 0. This bill removes the September 1, 1997, sunset provision from section 536.017 RSMo. The section requires a takings analysis when private property is acquired by a governmental entity. FISCAL NOTE: No impact on state funds. PROPONENTS: Supporters say that the bill removes the sunset provision from citizen protection legislation that requires a taking analysis on private property that may be subject to governmental acquisition. Testifying for the bill were Representatives Smith and Relford; Farm Bureau; Conservation Federation of Missouri; and Sierra Club. OPPONENTS: There was no opposition voiced to the committee.
