SCS/SB 140 - This act increases the enforcement methods for motor vehicle financial responsibility.
CRIME - The failure to have financial responsibility when driving a motor vehicle shall be a Class C misdemeanor. An officer may issue a citation whenever a driver does not have an insurance ID card.
REGISTRATION - Evidence of financial responsibility must be provided at the time of motor vehicle registration. The Department of Revenue must notify each vehicle owner of this requirement at least 30 days in advance. An affidavit as to the maintenance of financial responsibility shall be used instead of a statement (SA 4). Exceptions are made for commercial vehicles (SA 7).
AMOUNT OF INSURANCE - The minimum amount of coverage in a liability insurance policy is increased to $50,000 bodily injury for one person, $100,000 bodily injury for all persons and $50,000 property damage (SA 5).
MISC - Insurance verification is required whenever a non-insured accident report is made. The burden in agency liability determinations shall be against the driver. Reinstatement fees for suspended licenses are reduced from $200, $400 and $800 to $20 (SA 2).
EFFECTIVE DATE - January 1, 1998 (SA 1).
