SB 834- This act would amend Section 536.016, which contained a conditional effective date.
As amended, the section would limit agency rulemaking to only rules that are significant and no more restrictive than necessary to carry out the purposes of the rule's enabling statutes. Rules would be required to be based upon substantial evidence on the record after public hearing.
Other provisions require agencies to utilize formal
rulemaking to develop a procedure for determining that a rule is
significant and necessary, which incorporates empirical data and
a cost assessment to affected parties.
