AN ACT

To amend chapter 302, RSMo, by adding thereto one new section relating to driver's licenses.


Be it enacted by the General Assembly of the State of Missouri, as follows:

Section A.  Chapter 302, RSMo, is amended by adding thereto one new section, to be known as section 302.065, to read as follows:

302.065.  1.  Notwithstanding any other provision allowing for the issuance of an operator's license, no public high school student may apply for an operator's license unless the student has received the approval of the chief administrative officer of the district in which the student attends school.  No student attending a private, parochial or parish high school may apply for an operator's license unless the student has received the approval of the chief administrative officer of the school.  This requirement shall apply only to persons under the age of eighteen.

2.  The local school board of every public high school district and the chief administrative officer of every private high school in this state shall set the criteria which students must meet in order to be able to apply for a Missouri motor vehicle operator's license.  The criteria shall be related to high school purposes and may include requirements such as attendance, behavior and minimum grades.  The school or school district's chief administrative officer shall administer the policy and sign the approval forms.

3.  Every high school student who applies for an operator's license shall present an approval from the chief administrative officer of the public school district or private school.  The approval shall be validated with the signature of the chief administrative officer.

4.  The director of revenue shall design and provide to each public high school district and to each private, parochial or parish high school a common form for the application approval required by this section.  Every office of the department of revenue which handles driver's license applications shall require from every person under the age of eighteen either the approval, proof of graduation from high school, or an affidavit by the parent that the child is no longer attending school.

5.  Any person in a General Educational Development (GED) program shall be construed to be in high school for the purposes of this section.  The administrator of the GED program shall set the criteria for approval and approve the students meeting the criteria.  The director of revenue shall provide approval forms to the administrators of all GED programs.

6.  Every child of high school age in a home school shall be construed to be in high school for the purposes of this section.  The parent or guardian of the child shall set the criteria for approval and approve the students meeting the criteria.  The director of revenue shall provide approval forms to parents upon request and at all licensing offices.

7.  This section shall not apply to any person who has already received a valid motor vehicle operator's license.
