AN ACT

To amend chapter 643, RSMo, by adding thereto one new section relating to expedited permit review.


Be it enacted by the General Assembly of the State of Missouri, as follows:

Section A.  Chapter 643, RSMo, is amended by adding one new section, to be known as section 643.074, to read as follows:

643.074.  1.  Any person seeking to obtain a permit under section 643.075 to construct an air contaminant source may offer to reimburse the department for the costs of staff overtime or consultant services needed to expedite review of the permit application.  The reimbursement shall be in addition to any other fees imposed under this chapter.  The hourly charges for costs of staff overtime or consultant services needed to expedite review of permit applications pursuant to this section shall not be subject to the hourly charge limitation for review of construction permit applications established pursuant to section 643.075, and such hourly charges may be established at competitive market prices for such review services.

2.  If the department determines that additional resources are required to review the permit application in an expedited manner and that expediting the review will not disrupt permitting program priorities, the department may accept the reimbursement and provide expedited review.  Reimbursements received by the department shall be deposited in the natural resources protection fund - air pollution permit fee subaccount, created in section 640.220, RSMo, and shall be used to fund actual staff overtime and consulting fees incurred in providing expedited permit review under this section and for no other purpose.

3.  Reimbursement by a permit applicant shall precede and not be contingent upon issuance of a permit and shall not affect the agency's decision on whether to issue or deny a permit, what conditions are included in a permit or the application of laws and regulations governing decisions on review and approval or denial of permits.
