AN ACT

To amend chapter 104, RSMo, by adding thereto one new section relating to retirement benefit eligibility for certain elected officials.


Be it enacted by the General Assembly of the State of Missouri, as follows:

   Section A.  Chapter 104, RSMo, is amended by adding thereto one new section, to be known as section 104.364, to read as follows:

104.364.  Any present or former statewide elected official or member of the general assembly who is removed from office as provided by law or who, in connection with duties as a statewide elected official or member of the general assembly, is convicted of a felony involving fraud, embezzlement, bribery or corruption, shall not be eligible to receive any retirement benefits otherwise payable under this chapter after the date of the removal or conviction, for service rendered as a statewide elected official or as a member of the general assembly.  The provisions of this section shall not apply to any service rendered prior to August 28, 1998, or to any conviction which is later reversed by a court of law.
