AN ACT

To amend chapter 104, RSMo, by adding thereto one new section relating to forfeiture of retirement benefits by certain public officials.


Be it enacted by the General Assembly of the State of Missouri, as follows:

   Section A.  Chapter 104, RSMo, is amended by adding thereto one new section, to be known as section 104.369, to read as follows:

104.369.  1.  A person holding an elective state office or who has retired from an elective office who is convicted of, or pleads guilty to, a felony under the laws of this state to a crime involving misconduct in office or a crime which in any way is related to the duties of the person's office shall, upon final conviction, forfeit all rights to any publicly funded retirement benefits which such person would be entitled to by virtue of such person's tenure in such elective state office.

2.  The provisions of this section shall only apply to such benefits which accrue because of employer contributions and shall not apply to any benefit which shall accrue because of personal contribution made by the person.

3.  Nothing in this section shall be construed to require any person to repay any benefits received before the person has been convicted of a crime.

4.  The provisions of this section shall only apply to persons convicted of a crime which occurred after August 28, 1998.  The provisions of this act shall not apply to any conviction which is later reversed by a court of law.
