AN ACT

To repeal section 211.156, RSMo 1994, relating to the care and detention of certain children, and to enact in lieu thereof one new section relating to the same subject, with an emergency clause.


Be it enacted by the General Assembly of the State of Missouri, as follows:

   Section A.  Section 211.156, RSMo 1994, is repealed and one new section enacted in lieu thereof, to be known as section 211.156, to read as follows:

211.156.  1.  Whenever a county shall own or operate an institution as a home for neglected and delinquent children, the state of Missouri shall pay to the county toward the care and maintenance of each of these children, upon an order or voucher submitted to the state by the circuit court the following amount:

(1)  Until June 30, 1990, eight dollars per day;

(2)  Beginning July 1, 1990, and until June 30, 1991, ten dollars per day;

(3)  Beginning July 1, 1991, and until June 30, 1992, twelve dollars per day;

(4)  Beginning July 1, 1992, fourteen dollars per day;

(5)  Beginning July 1, 1998, thirty-seven dollars and fifty cents per day.

2.  Whenever a child is detained as provided in section 211.151, the state shall pay to the county governing body toward the care and maintenance of each such child upon a voucher or order submitted to the state by the circuit court the amount specified in this subsection.  When submitting the voucher or order to the state, the circuit court shall certify that the child was detained only in a manner as provided by section 211.151.  The amount to be paid to the county governing body is as follows:

(1)  Until June 30, 1990, eight dollars per day;

(2)  Beginning July 1, 1990, and until June 30, 1991, ten dollars per day;

(3)  Beginning July 1, 1991, and until June 30, 1992, twelve dollars per day;

(4)  Beginning July 1, 1992, fourteen dollars per day;

(5)  Beginning July 1, 1998, thirty-seven dollars and fifty cents per day.

Section B.  Because the costs for the care and detention of certain children in Missouri counties require increased state funding this act is deemed necessary for the immediate preservation of the public health, welfare, peace and safety, and is hereby declared to be an emergency act within the meaning of the constitution, and this act shall be in full force and effect upon its passage and approval.
