AN ACT

To repeal section 105.010, RSMo 1994, relating to public officers and employees, and to enact in lieu thereof one new section relating to the same subject.


Be it enacted by the General Assembly of the State of Missouri, as follows:

Section A.  Section 105.010, RSMo 1994, is repealed and one new section enacted in lieu thereof, to be known as section 105.010, to read as follows:

105.010.  1.  All officers elected or appointed by the authority of the laws of this state shall hold their offices until their successors are elected or appointed, commissioned and qualified.  

2.  The appointing authority of any state administrative board, commission or committee shall, when selecting officers and members of such board, commission or committee, give consideration to and shall appoint such officers and members in equal numbers of each gender.  If such appointing authority concludes that an equal number of officers and members of each gender cannot be appointed, then such appointing authority shall give consideration to and shall appoint such officers and members in numbers which are as near equal as possible of each gender.  When advice and consent of the senate is required on any appointment which would result in an unequal number of officers and members of each gender, such appointing authority shall provide a written explanation as to why the board, commission or committee would not contain equal numbers of officers and members of each gender.  For any appointment which would result in an unequal number of officers and members of each gender, the appointing authority shall provide a written explanation to the board, commission or committee, and to any other person upon request, as to why the board, commission or committee would not contain equal numbers of officers and members of each gender.
