AN ACT

To amend chapter 190, RSMo, relating to automatic external defibrillatory use by certain firefighters by adding thereto one new section relating to the same subject.


Be it enacted by the General Assembly of the State of Missouri, as follows:

Section A.  Chapter 190, RSMo, is amended by adding thereto one new section, to be known as section 190.097, to read as follows:

190.097.  1.  Any firefighter employed by a municipally operated fire department in a city not within a county is authorized to use an automatic external defibrillator for the purpose of saving the life of a person in cardiac arrest.

2.  All firefighters who have access to or use an automatic external defibrillator shall obtain appropriate training, to include completion of a course in cardiopulmonary resuscitation and successful completion of a first responder program meeting or exceeding the national curricula of the United States Department of Transportation, and shall demonstrate proficiency in the use on an automatic external defibrillator.

3.  Any firefighter, including those licensed as an emergency medical technician or paramedic, who in good faith renders emergency care or treatment by the use of an automatic external defibrillator, without objection of the injured or ill victim or victims upon whom such defibrillator is used, shall not be held liable for any civil damages as a result of such care or treatment.
