AN ACT

To amend chapter 182, RSMo, by adding thereto one new section relating to public library access to pornography over the Internet.


Be it enacted by the General Assembly of the State of Missouri, as follows:

   Section A.  Chapter 182, RSMo, is amended by adding thereto one new section, to be known as section 182.905, to read as follows:

182.905.  1.  All public libraries shall acquire, install and maintain on all personal computers available to the public and with access to the Internet software that blocks the availability of pornographic material over the Internet.  The software required by libraries to block the availability of pornographic material shall be in use at all times the Internet is accessed.

2.  For purposes of this section, the "Internet" refers to an international series of computer networks that facilitates the provision and movement of information.  The Internet consists of, but is not limited to in its composition, the World Wide Web, usenet newsgroups, Internet relay chat (IRC), telnet, file transfer protocol (FTP) and electronic mail.

3.  Notwithstanding the provisions of subsection 1 in this section, public libraries shall have the discretion to temporarily disable software whose primary function is to block out the availability of pornographic material when such software prohibits the access to non-pornographic material over the Internet.

4.  The commissioner of administration shall develop procurement procedures pursuant to section 37.005, RSMo, for software obtained pursuant to this section.   Libraries may submit the proper documentation to the office of administration for the purchase of software pursuant to this section and shall receive reimbursement for the purchase of such software if the purchase adheres to the requirements of this section.
