AN ACT

To repeal section 162.890, RSMo 1994, relating to special school districts, and to enact in lieu thereof one new section relating to the same subject.


Be it enacted by the General Assembly of the State of Missouri, as follows:

Section A.  Section 162.890, RSMo 1994, is repealed and one new section enacted in lieu thereof, to be known as section 162.890, to read as follows:

162.890.  1.  If a special district is organized in any area of this state under the provisions of sections 162.670 to 162.995, neither the state board of education nor any school district within the special district shall be required to establish schools or classes for the training or education of handicapped or severely handicapped children under any other existing law, except that the component districts included in a newly formed special district and the state board of education shall continue to provide services formerly provided for children residing in the district until the resources of the special district are sufficient to permit its assuming such responsibilities.  In no instance shall component districts or the state board of education be required to provide special education classes for the training or education of these children for more than one school term after the special district has been formed.

2.  The state board of education shall promulgate rules to establish a process whereby a school district within a special school district may assume responsibility for providing education for one or more defined classes of students with disabilities resident within the school district.  Upon receiving written notification from such school district, pursuant to the manner provided by rule, the school district shall assume full responsibility for education of the designated resident pupils and the special school district shall provide the proportionate share of revenues to the school district for such pupils in the manner and amount as established by rule.
