AN ACT

To repeal section 197.313, RSMo Supp. 1997, relating to care facility licensure, and to enact in lieu thereof one new section relating to the same subject.


Be it enacted by the General Assembly of the State of Missouri, as follows:

Section A.  Section 197.313, RSMo Supp. 1997, is repealed and one new section enacted in lieu thereof, to be known as section 197.313, to read as follows:

197.313.  A continuing care retirement community, skilled nursing facility or residential care facility I or II may increase its licensed bed capacity by the lessor of ten beds or ten percent only once during the two-year period beginning on July 12, 1996, and ending on July 11, 1998.  A facility's increase in beds pursuant to this section shall only be within the same licensure category.  Facilities that have notified the committee of projects under this section and have substantially completed the same prior to July 11, 1998, shall be allowed a commercially reasonable time to complete and license the beds associated with such projects.
