JOINT RESOLUTION

Submitting to the qualified voters of Missouri, an amendment to Article X of the Constitution of Missouri relating to disposition of funds received as a result of certain legal settlements.


Be it resolved by the Senate, the House of Representatives concurring therein:

That at the next general election to be held in the state of Missouri, on Tuesday next following the first Monday in November, 1998, or at a special election to be called by the governor for that purpose, there is hereby submitted to the qualified voters of this state, for adoption or rejection, the following amendment to article X of the Constitution of the State of Missouri:

Section A.  Article X, Constitution of Missouri, is amended by adding thereto one new section, to be known as section 25, to read as follows:

Section 25.  Any funds received by the state of Missouri as a result of any legal settlement or award related to public health or health-related issues of smoking, if approved by the Congress of the United States or decided in the federal courts, shall be used for health purposes or such other purposes as are specified in the settlement agreement, but shall be subject to appropriation.  Such funds shall be considered "federal funds" as used in section 18 of this article, and not as "penalties, forfeitures and fines" as provided in article IX, section 7.
