JOINT RESOLUTION

Submitting to the qualified voters of Missouri, an amendment repealing section 8 of article III of the constitution of Missouri relating to term limits, and adopting one new section in lieu thereof relating to the same subject.


Be it resolved by the Senate, the House of Representatives concurring therein:

   That at the next general election to be held in the state of Missouri, on Tuesday next following the first Monday in November, 1998, or at a special election to be called by the governor for that purpose, there is hereby submitted to the qualified voters of this state, for adoption or rejection, the following amendment to article III of the Constitution of the State of Missouri:

Section A.  Section 8, article III, constitution of Missouri, is repealed and one new section adopted in lieu thereof, to be known as section 8, to read as follows:

Section 8.  No one shall be elected to serve more than six two-year terms in the house of representatives and no one shall be elected to serve more than three four-year terms in the senate of the General Assembly, except as provided in this section.  For the purposes of this section, service in the General Assembly resulting from an election prior to the effective date of this section or service of less than a full term in a house of the General Assembly shall not be counted.  A petition proposing service beyond the six two-year terms for house or three four-year terms for senate signed by at least two percent of the qualified voters in the appropriate district who voted at the last election for candidates for the office being sought or ten thousand qualified voters, whichever is less, if submitted to the secretary of state at least six months prior to the general election or at an earlier time provided by law, shall qualify such person to seek such office as provided by law.[Section 8.  No one shall be elected or appointed to serve more than eight years total in any one house of the General Assembly nor more than sixteen years total in both houses of the General Assembly.  In applying this section, service in the General Assembly resulting from an election or appointment prior to the effective date of this section shall not be counted.]
