JOINT RESOLUTION

Submitting to the qualified voters of Missouri, an amendment repealing section 39(e) of article III of the Constitution of Missouri relating to riverboat gambling, and adopting one new section in lieu thereof relating to the same subject.


Be it resolved by the Senate, the House of Representatives concurring therein:

That at the next general election to be held in the state of Missouri, on Tuesday next following the first Monday in November, 1998, or at a special election to be called by the governor for that purpose, there is hereby submitted to the qualified voters of this state, for adoption or rejection, the following amendment to article III of the Constitution of the state of Missouri:

Section A.  Section 39(e), article III, Constitution of Missouri, is repealed and one new section adopted in lieu thereof, to be known as section 39(e), to read as follows:

Section 39(e).  The general assembly is authorized to permit only upon the Mississippi River, [and] the Missouri River, and in artificial basins located within one thousand feet from the closest edge of the main channel of either river which are filled with the water of that river and are created prior to the adoption of this amendment, lotteries, gift enterprises and games of chance to be conducted on excursion gambling boats and floating facilities.  No lotteries, gift enterprises or games of chance shall be allowed in any artificial basin created after the adoption of this amendment, except that any facility located in an artificial basin created before that date may be expanded in any area within that artificial basin as authorized by law.
