AN ACT

Relating to licensing of certain construction professionals.


Be it enacted by the General Assembly of the State of Missouri, as follows:

Section 1.  1.  Notwithstanding the provisions of section 77.505, RSMo, any city, town or village in any county of the third classification may provide, by ordinance, for the licensing of persons who perform electrical work or plumbing work for compensation or holds himself or herself out as a qualified electrician or plumber within such city, town or village, regardless of whether such person is licensed to perform similar work in another jurisdiction.

2.  Any city, town or village authorized to license persons who perform electrical work pursuant to subsection 1 of this section may require a person to pass an electrical work examination that is approved by such city, town or village in order to receive such license.

3.  Any city, town or village authorized to license persons who perform plumbing work pursuant to subsection 1 of this section may require a person to pass a plumbing work examination that is approved by such city, town or village in order to receive such license.

4.  Any city, town or village authorized to license persons who perform electrical work or plumbing work pursuant to subsection 1 of this section may require the payment of a fee in order for a person to receive such license.  Such fee shall be calculated so that the total of all fees collected shall not exceed the cost of administering the provisions of this section.

5.  Those persons performing electrical work as part of their employment by any utility, including, but not limited to, any such utility that is created or regulated pursuant to chapter 91, RSMo, chapter 393, RSMo, or chapter 394, RSMo, or as part of their employment by a railroad corporation, as defined in section 388.010, RSMo, shall not be subject to licensure pursuant to this section.

6.  No electrician or plumber who is employed on a full-time basis, and not as an independent contractor, by a company to do electrical or plumbing installation or maintenance for such company on such company's property shall be subject to licensure pursuant to the provisions of this section.
