AN ACT

To repeal section 247.180, RSMo Supp. 1997, relating to elections, and to enact in lieu thereof one new section relating to the same subject.


Be it enacted by the General Assembly of the State of Missouri, as follows:

Section A.  Section 247.180, RSMo Supp. 1997, is repealed and one new section enacted in lieu thereof, to be known as section 247.180, to read as follows:

247.180.  1.  Regular elections and elections held for the purposes of section 247.130 shall be held annually on the first Tuesday after the first Monday in June or on any election day specified in section 115.123, RSMo.  Such elections shall be conducted by the appropriate election authority pursuant to chapter 115, RSMo.

2.  Notwithstanding any other provision of law, if the number of candidates is no greater than the number of directors to be elected, no election shall be held, and the candidates shall assume the responsibilities of their offices at the same time and in the same manner as if they had been elected.
