FISCAL ANALYSIS

ASSUMPTION

Officials from the Department of Elementary and Secondary Education and the Department of Social Services assume this proposal would not fiscally impact their agencies.

Department of Mental Health (DMH) officials state the proposal would give more flexibility to county boards in the types of services they provide. DMH states the proposal changes the "may" to "shall", which means the county boards would be mandated to provide sheltered workshops and residential services. DMH states that some county boards now use part of their funds for sheltered workshops, other county boards may not. In addition, DMH states that some county boards may use funds for residential services, and others may not. DMH states that in an effort to provide sheltered workshops and residential services, the county boards may have to take dollars currently sent to DMH to match waiver services for DMH clients. DMH assumes this proposal could have a potential fiscal impact for DMH of $0 to $4,411,390 in the Mental Health Trust Fund. DMH state the Mental Health Trust Fund is used as match for the Home and Community Based waiver Medicaid Program. Therefore, DMH states another $0 to $7,067,085 in federal Medicaid match dollars could be lost. DMH estimates this could result in up to 942 clients not receiving community supports. In addition, DMH states that loss of federal match would also be lost by the county boards.

The Boone County Group Homes and Family Support, the Franklin County Board for the Handicapped, and Cole County Residential Services did not respond to our fiscal impact request.

FISCAL IMPACT - Small Business

No direct fiscal impact to small businesses would be expected as a result of this proposal.

DESCRIPTION

This proposal would authorize county boards for developmental disabilities, known as "SB 40 Boards", to provide "related services" as defined in this proposal to cover services needed by persons with developmental disabilities, except that all new "related services" provided after the August 28, 1998, would be provided under a contract with the county board. Each county board DESCRIPTION (continued)

would establish an advisory council as specified in the proposal. The advisory council would coordinate an independent community needs assessment, assist in creating a plan to address the identified need, and make an annual report on progress in implementing the plan. The proposal

provides that the county board would have full control over all activities of the board, in addition to the facilities established by the board. The county board would expend its funds for any purpose authorized for county boards in Sections 205.968 to 205.972, RSMo.

This legislation is not federally mandated, would not duplicate any other program and would not require additional capital improvements or rental space.
