FISCAL ANALYSIS
ASSUMPTION
The Office of Administration (COA)-Division of Budget & Planning and the Sheriff's Association do not expect to be fiscally impacted.
The Department of Revenue (DOR) assumes that it would incur some start-up costs with on-going costs being absorbed. The DOR would be required to revise and distribute a motor vehicle procedures manual and titling manual as well as send a letter and proper forms to 115 county sheriffs.
This proposal would result in income to the County Law Enforcement Fund in each county, if in existence, or to the county general revenue fund. The amount of revenue would be unknown since the DOR does not track registered trailers by length or whether they are homemade. For purposes of this fiscal note, Oversight has shown unknown income to the County Law Enforcement Fund.

This proposal would have a direct fiscal impact on small businesses since registered inspectors would no longer be receiving an inspection fee for trailers.
DESCRIPTION
The proposal would require a certificate of inspection prior to a certificate of ownership being issued for a previously untitled trailer sixteen feet or more and is homemade. The inspection would be conducted by the county sheriff with a $10 fee being paid. The fee would be deposited into the county law enforcement fund, if one exists, or the county general revenue fund. Inspection procedures would be established as well as procedures for seizing a stolen trailer or one with the identifying numbers obliterated or removed. Upon inspection, the sheriff could require improvements if the trailer would be unsafe on the highways. The calculation of sales tax due would not be applicable to the trailers inspected under section 301.191.
This legislation is not federally mandated, would not duplicate any other program, would not require additional capital improvements or rental space and would not impact total state revenue.
