FISCAL ANALYSIS
ASSUMPTION
Officials from the Office of Administration, Missouri Consolidated Health Care Plan, Department of Health, Department of Conservation, Department of Social Services, Department of Mental Health, Department of Transportation, and Department of Public Safety - Missouri State Highway Patrol assume this proposal would not impact their agencies.
Officials from the Department of Corrections (DOC) state they cannot predict the number of new commitments which may result from the creation of the offense(s) outlined in this proposal. DOC states that an increase in commitments depends on the utilization by prosecutors and the actual sentences imposed by the court. DOC further states that if additional persons are sentenced to the custody of DOC due to the provisions of this proposal, DOC would incur a corresponding increase in operational costs either through incarceration (average of $30.47 per inmate per day) or through supervision provided by the Board of Probation and Parole (average of $2.47 per offender per day. Supervision by DOC through probation or incarceration would result in some additional costs but it is assumed that the impact would be minimal.

No direct fiscal impact to small businesses would be expected as a result of this proposal.
DESCRIPTION
This proposal would: (1) Define a partial-birth abortion as an abortion in which a child is (a) intentionally delivered a considerable part of the way out of the womb for the purpose of killing the child, or (b) killed while the child is considerable part of way out of the womb; (2) Make a person who knowingly performs a partial-birth abortion guilty of a Class A felony, punishable by 10 to 30 years, or life imprisonment; and (3) Make a person who kills a child born live after an abortion attempt guilty of second degree murder, also a Class A felony.

This legislation is not federally mandated, would not duplicate any other program and would not require additional capital improvements or rental space.
