FISCAL ANALYSIS
ASSUMPTION
Officials of the Department of Social Services, Department of Elementary and Secondary Education, , Department of Public Safety, Division of Highway Patrol, Department of Health, Department of Mental Health, Department of Corrections, and Office of State Courts Administrator assume this proposal would not fiscally impact their agencies.
Officials from the Office of Administration (OA) indicated the Missouri Children's Service Commission (Commission) is assigned to the OA for budgetary purposes only and will include the necessary financial resources for the Commission in their annual budget submittal.
Oversight notes the Commission is composed of the following members: a representative from the Departments of Mental Health, Elementary and Secondary Education, Social Services, Public Safety and Health; a juvenile court judge; a family court judge; four Representatives; and four Senators as required by Section 210.101 RSMo.
Officials from the Children's Trust Fund (CTF) assume the proposal would not fiscally impact the CTF. However, the CTF indicated they are required to "consult with applicable state agencies, commissions, and boards to help determine probable effectiveness, fiscal soundness, and need for proposed community-based, educational and service prevention programs." Although the CTF indicated the proposal does not specifically duplicate their responsibility, they suggested the CTF be considered as a potential partner and funding mechanism for the Commission's study or report to the governor and legislature. The CTF believes the study will cost between $100,000 and $150,000 for a paid consultant to perform the research necessary for the report. The CTF indicated the significant cost associated with this type of study is the cost of accessing the necessary data on incarcerated parents and children across public and private funding streams. The CTF also indicated that, other than the paid consultant, there should be no additional new employee costs.
Oversight assumes the cost of this proposal would be based on how the Commission implemented the legislation's requirements. Oversight assumes the proposal would not require the Commission to meet more frequently than already required by law, once every two months. Therefore, any costs associated with the proposal would result from the first report required to be presented to the governor and the legislature by December 1, 1999. The proposal requires various state agencies to provide information to the Commission as necessary. Based on responses from these state agencies, the information gathering will not result in any additional costs to state or local funds.
ASSUMPTION (continued)
Oversight assumes the report and any necessary studies could be either performed by state agencies using existing resources or by outside contractors. Oversight assumes, for the purposes
of this fiscal note, the Commission could add this responsibility to the existing responsibilities noted in Section 210.102 RSMo at no additional costs to state or federal funds.
It should be noted the proposal requires a second report by December 1, 2002, which is outside the scope of this fiscal note.

No direct fiscal impact to small businesses would be expected as a result of this proposal.
DESCRIPTION
This proposal authorizes the Missouri Children's Services Commission to evaluate current state policies that affect incarcerated parents and their children. The Commission is encouraged to provide alternative approaches to the needs of children of incarcerated parents.
This legislation is not federally mandated, would not duplicate any other program and would not require additional capital improvements or rental space.
