FISCAL ANALYSIS

ASSUMPTION

Officials of the Department of Corrections, Department of Public Safety - Missouri State Highway Patrol, Office of Prosecution Services, State Public Defender, Missouri Sheriffs' Association, and Missouri Police Chiefs' Association assumed this proposal would have no fiscal impact to their agencies.

Officials of the State Courts Administrator would not expect the number of violations to be so great as to significantly impact the workload of the courts.

No direct fiscal impact to small businesses would be expected as a result of this proposal.



DESCRIPTION

This proposal would change prohibition of possession of alkaloids in correctional centers from "any alkaloid of any kind" to "any alkaloid of any controlled substance". In addition, anyone previously convicted under that provision would be entitled to an expungement, the procedure for which would be identical to that for expungement of an arrest record. The record of any person would not be expunged if that person had been found guilty or had pled guilty to knowingly delivering, attempting to deliver, having in his possession, or deposition or concealing any alkaloid of any controlled substance in or about the premises of any correctional center.

This legislation is not federally mandated, would not duplicate any other program and would not require additional capital improvements or rental space.
