SCS/HCS/HB 1536 - This act expands upon current law authorizing the Missouri Director of Revenue to require examinations and suspend operators of motor vehicles who are no longer qualified to drive. It is very similar to the perfected version of SB 522.

EXAMINATIONS, DENIAL - The Director may require written, driving, vision, sign recognition, and physical or mental exams. Further periodic examinations may be required. Upon completion of the exam, a person's driver's license may be "denied" in addition to the current suspension or revocation.

REPORTS - The Director of Revenue may determine that a motor vehicle operator is incompetent to continue driving upon receiving a report from a law enforcement officer, certain medical professionals, or close family members. Reports by family members are limited to one per 12 month period. A person must make a report in good faith and shall be immune from civil liability. A physician-patient relationship shall not prevent the making of a report. Information reported shall be kept confidential. The Department of Revenue shall keep records of reports made and actions taken.

HELP FOR LICENSEES - Requests may be made for reinstatement of a license where the person's condition has improved.

MEDICAL ADVISORY BOARD - The Department of Revenue shall establish guidelines for reporting in consultation with a medical advisory board. A medical/vision advisory board is established to advise the Director of Revenue on medical criteria for the reporting and examination of drivers. Three physicians appointed by the Director of Revenue shall serve in a voluntary capacity. The guidelines and regulations shall comply with the federal Americans with Disabilities Act.

PENALTIES - A violation of confidentiality is a Class A misdemeanor. The filing of a false report is a Class A misdemeanor. A civil action is also created for both violations.

EFFECTIVE DATE - The effective date is January 1, 1999.
