SCS/HB 1566 - This act provides that a plaintiff has a cause of action for triple actual damages, or at least $1,000 plus costs, if: 1) the plaintiff proves that he was injured due the defendant's actions that resulted in convictions for distribution of a controlled substance, trafficking in the first or second degree or possession of precursor chemicals; and 2) the plaintiff was not a participant in the same act that resulted in the conviction. The triple damages may be recovered from the parent or legal guardian of an unemancipated minor less than 15 years of age who is liable and lives with the parent or guardian who was aware of or recklessly disregarded facts demonstrating the minor's intent to commit the act.
