HB 1136 -- NURSING HOMES (Stokan) Current law requires the Department of Social Services to notify facility administrators and certain agencies in cases where a nursing home or residential care facility is in violation of prescribed standards, or remains in noncompliance with prescribed standards. This bill requires that in cases involving a violation of a Class I standard a written report be sent to the State Representative and State Senator for the district in which a nursing home or residential care facility is located. In addition, a copy of any notice of noncompliance issued to the facility must also be sent to the State Representative and State Senator for the district in which the facility is located. FISCAL NOTE: No impact on state funds.
HB 1136 -- NURSING HOMES SPONSOR: Stokan COMMITTEE ACTION: Voted "do pass by consent" by the Committee on Public Health and Safety by a vote of 16 to 0. Current law requires the Department of Social Services to notify facility administrators and certain agencies in cases where a nursing home or residential care facility is in violation of prescribed standards, or remains in noncompliance with prescribed standards. This bill requires that in cases involving a violation of a Class I standard a written report be sent to the State Representative and State Senator for the district in which a nursing home or residential care facility is located. In addition, a copy of any notice of noncompliance issued to the facility must also be sent to the State Representative and State Senator for the district in which the facility is located. FISCAL NOTE: No impact on state funds. PROPONENTS: Supporters say that this bill requires that when a violation occurs on one of the premises that copies of the written report of the violation and the correction order be sent in a timely fashion to state legislators for the district in which the facility is located.
