HCS/SS/SB 478 - This act allows probation and parole officers, supervisors and members of the Board of Probation and Parole to carry firearms at all times. Mere possession of a firearm shall not constitute an employment activity for the purpose of calculating compensatory time or overtime.

The Department of Corrections shall promulgate policies governing the use of firearms when officers, supervisors and members of the Board are carrying out their duties. Any rule promulgated under this authority shall become effective only if the agency has fully complied with the requirements of Chapter 536, RSMo. All rulemaking authority delegated prior to the effective date of this act has no force and effect and is repealed, however, the validity of any rule adopted and promulgated prior to the effective date of this act is not interpreted to be repealed.

This act also authorizes the public sale of part of Church Farm Correctional Facility in Cole County. The property to be sold shall be described in a survey authorized by the Division of Design and Construction in the Office of Administration. The Division of Design and Construction shall authorize independent appraisals and the Commissioner of Administration shall set terms and conditions for the public sale as the Commissioner deems reasonable. All costs shall be paid from proceeds of the sale. All excess proceeds from the sale shall be used to assist the funding of construction, repair or maintenance of state correctional facilities.

This act also authorizes the Governor to convey a 60-foot wide easement to Cole County which is used by the Department of Corrections for establishing and maintaining a public road. The Attorney General shall approve the form of the instrument of conveyance.
