SB 480 - This act establishes penalties for those persons receiving public assistance benefits who test positive for the use of a controlled substance. Those persons who receive public assistance are deemed to have consented to a drug test. Those who test positive for the use of a controlled substance not prescribed by a physician may be placed on probation, forced to forfeit public assistance benefits, required to attend a drug rehabilitation program, and declared ineligible for public assistance benefits for three years. The act also affects those on public assistance who are found guilty of violating drug regulations or have pleaded guilty to violating drug regulations. Such persons may be put on probation or declared ineligible to receive public assistance benefits for a period not to exceed five years.
