SB 89 - This act requires the filing of affidavits in civil suits against architects, engineers and surveyors.

The plaintiff must file an affidavit from a similarly licensed professional before the suit can proceed. If a claim is filed without an affidavit, the court may dismiss such claim without prejudice. Similar provisions are in place for health care providers (Section 538.225, RSMo).

In addition, all persons entering into a contract for private design or construction work to make scheduled payments under the term of the contract. "Design or construction work", for the purposes of this section is defined.

The act does not affect actions filed in small claims court. Portions of this act are similar to SB 589 from 1998.
