Current Bill Summary

SB 101 - This act authorizes the disclosure of information about current or past employees to new or prospective employers. The same information is available to any former employee upon request. The employer may disclose: dates of employment; pay; job description; wage history; and conditions of separation from the employer's service.

Any employer who discloses the information described above is immune from civil liability, unless the employer's response is shown to be false and made with knowledge that it was false or with reckless disregard for whether such response was true or false at a time when the employer had serious doubt whether such response was true.

This act is similar to SB 155, HB 441 and truly agreed to HS/SB 32 (1999).
