SCS/SB 211 - This act concerns the establishment and distribution of trusts within the Missouri family Trust. It reenacts Sections 402.199 to 402.217, RSMo. These sections, along with Sections 473.657 and 473.093, RSMo, were originally passed in SB 768 in 1996. SB 768 was held unconstitutional in May, 1998 by the Missouri Supreme Court due to problems with enactment and, as a result, these sections must be reenacted.
The act also deletes all references to the word "handicap"
and replaces them with the word "disability". In addition, the
Department of Mental Health is removed from certain portions of
Section 402.215.2(12). As a result, the Department will not be
allowed to decide on the amount of charitable trust income to be
used to provide benefits and it will no longer be the sole
provider of benefits. This act is substantially similar to HB
839.
