Current Bill Summary

HCS/SCS/SB 233 - Current law limits the ability of state funded institutions that provide residential care for students to place those students in the local school. Such placement can only occur if the placement is ordered by a court or the institution contracts with the district and pays the actual cost for the services.

This act removes the requirement for a contract but continues to require the originating school district to pay a per pupil amount to the new domiciliary district. It also allows the Department of Elementary and Secondary Education to pay in lieu of the domiciliary district.

Current law prohibits the readmission of public school pupils who have committed one of the offenses specified in Section 167.171, RSMo. The act provides such pupils may be re- enrolled in an alternative education program if the district offers such a program and determines it is appropriate.
