Current Bill Summary

SB 303 - This act amends provisions of law pertaining to sovereign immunity. It:

- Increases the amount of maximum liability for the state or political subdivision from one to two million dollars for a single accident or occurrence;

- Increases the maximum liability for injury to individual persons from one to three hundred thousand dollars;

- Caps medical expenses at $250,000;

- Removes joint and several liability;

- Removes sovereign immunity as a defense to attorney's liens;

- Adds penalties for frivolous claims;

- Extends liability limits to police officers outside of the officer's jurisdiction if the officer was authorized to act;

- Clarifies that the Missouri Risk Management Fund is available only to covered public entities;

- Provides for annual review of the limitation on awards based on an economic price index; and

- Increases the floor for requiring the payment of corporation franchise tax from the current $200,000 to one million dollars and reduces the rate from the current 1/20th of one percent to forty-five thousandths of one percent (for all taxable years beginning on or after January 1, 2000).

A portion of this act is similar to HS/HCS/SCS/SBs 295 & 46. This act has an emergency clause.
