SCS/SBs 398 & 376 - This substitute combines SBs 398 and
376, both of which deal with financial exploitation of the
elderly. This substitute creates the role of an "elderly
fiduciary" and "person in a position of trust." It describes
specific ways that an elderly fiduciary in a position of trust
can commit financial exploitation of the elderly. If this act
involves $150.00 or less, it is a Class A misdemeanor, which
could result in up to one year in jail. If the act involves over
$150.00, it is a Class D felony and could result in one year or
more in jail. Any instance of financial exploitation may be
reported to the Department of Social Services when there is
reasonable cause to believe it has occurred.
