SB 459 - This act provides that each state college and university shall admit a student as an undergraduate if the student graduates from an accredited public or private high school in this state with a grade-point average in the top ten percent of the student's high school graduating class.

If the number of applicants entitled to automatic admission exceeds the available number of spaces at the institution, the institution shall conduct a lottery to award the spaces to eligible applicants and an eligible applicant not selected for admission may delay admission to the institution until space is available.

If a high school student with a grade-point average in the top ten percent of the student's high school class at the beginning of a semester does not graduate at the end of that semester, or fails to graduate with a grade-point average in the top ten percent of the student's graduating class, the institution may withdraw an offer of admission to the student, even if the student has accepted the offer.

An offer of admission to a student must indicate whether the offer may be withdrawn and that the student's acceptance of the offer is conditioned on the student graduating at the end of that semester as provided by the act.
