AN ACT

Relating to school attendance.


Be it enacted by the General Assembly of the State of Missouri, as follows:

Section 1.  1.  The director of the division of family services shall periodically check the attendance records of children who are required by law to attend school whose family receives temporary assistance to needy families.

2.  If such child does not attend school, the director shall send a certified letter to the parents advising that the child was not in school and the consequences of subsequent failure to attend.

3.  Upon failing a second attendance check, temporary assistance to needy families benefits may be suspended for one month.  If the child is still not attending after a third attendance check, benefits may be suspended for two months.  If the child is not attending after a fourth attendance check, benefits may be suspended until the next school year unless the child returns to school.

4.  The director may establish by rule, an appeal procedure to review any such suspension of benefits.

5.  No rule or portion of a rule promulgated pursuant to the authority of this section shall become effective unless it has been promulgated pursuant to the provisions of chapter 536, RSMo.
