JOINT RESOLUTION

Submitting to the qualified voters of Missouri, an amendment to article X of the Constitution of Missouri relating to the disposition of funds relating to certain legal settlements.


Be it resolved by the Senate, the House of Representatives concurring therein:

That at the next general election to be held in the state of Missouri, on Tuesday next following the first Monday in November, 2000, or at a special election to be called by the governor for that purpose, there is hereby submitted to the qualified voters of this state, for adoption or rejection, the following amendment to article X of the Constitution of the state of Missouri:

Section A.  Article X, Constitution of Missouri, is amended by adding thereto one new section, to be known as section 25, to read as follows:

Section 25.  Any funds received by the state of Missouri as a result of any legal settlement or award related to tobacco-related products shall be deposited in a special trust fund to be known as the "Tobacco Settlement Trust Fund", which is hereby created, and shall be held in perpetuity.  Interest accruing to such fund shall be subject to appropriation for programs related to children's health, as provided by law.  Any principal funds received may be used if the emergency conditions specified in article X, section 19 of the Constitution of the state of Missouri are met.  The moneys deposited into the fund, and any interest accruing to such fund, shall not be included within the definition of "total state revenues" in section 17 of this article of this constitution.
