AN ACT

Relating to the establishment of the Missouri settlement trust fund.


Be it enacted by the General Assembly of the State of Missouri, as follows:

Section 1.  1.  There is hereby created in the state treasury the "Missouri Settlement Trust Fund".

2.  The state treasurer shall deposit in the Missouri settlement trust fund all moneys received by the state which are the proceeds of any award or settlement.

3.  Notwithstanding the provisions of section 33.080, RSMo, to the contrary, moneys deposited in the Missouri settlement trust fund, including any interest thereon, shall not revert to the credit of the general revenue fund at the end of the biennium.

4.  The moneys deposited in the Missouri settlement trust fund, including any interest thereon, shall not be expended or appropriated without additional statutory authority specifying the purposes of such appropriation.

5.  The creation of the Missouri settlement trust fund and the deposit of moneys into the trust fund shall not be construed as evidence that the moneys in the trust fund are included or not included in total state revenues as defined in article X, section 17, of the Missouri Constitution.

6.  The moneys deposited in the Missouri settlement trust fund are not dedicated to any specific purpose or purposes.

7.  The commissioner of administration shall maintain data in an electronic

format on receipts to the fund.  Such data shall be updated at least quarterly and shall be available to the public on the Internet.

8.  Any attorneys acting on behalf of the state of Missouri in a dispute between this state and any company which manufactures, sells or promotes tobacco or tobacco products shall receive compensation solely pursuant to lawful appropriation by the general assembly.
