FISCAL ANALYSIS
ASSUMPTION
Officials of the following agencies/offices/commissions stated that either they would not have be fiscally impacted by this bill or that they could absorb the costs of any new duties:
Office of Administration, Department of Agriculture, Missouri Conservation Department, Department of Corrections, Department of Economic Development, Department of Elementary and Secondary Education, Department of Health, Department of Transportation, Department of Labor and Industrial Relations, Department of Insurance, Department of Public Safety, Coordinating Board of Higher Education, Department of Revenue, Department of Social Services, Governor, Lieutenant Governor, Secretary of State, Attorney General, State Courts Administrator, State Tax Commission, Veterans Commission, Chief Clerk of the House, Missouri Consolidated Health Care Plan, Prosecution Services, University of Missouri, Central Missouri State University, Truman State University, Harris-Stowe State College, Missouri Western State College, Linn Technical State College.
Officials of the Kansas City Transit Area Transportation Authority and the City of Kansas City noted that the proposal could adversely affect minority and women businesses. Kansas City stated that approximately $500,000 a year in personnel costs for affirmative action monitoring would be eliminated as a result of this proposal. In addition, Kansas City indicated that approximately $30,000,000 to $40,000,000 a year in capital improvements expenditures with MBE/WBE firms would be eliminated as a result of this proposal. Oversight assumes that Kansas City would still expend funds for capital improvement projects with other firms and the personnel currently working on affirmative action monitoring would still be required for those projects that are funded with federal money, or other programs, and therefore assumes the fiscal impact would be $0.
Officials of several departments noted that the proposal allows state agencies and political subdivisions to conform to federal laws, rules and regulations to the extent needed to guarantee continued federal funding of the programs.

DESCRIPTION
This proposal would repeal all preferential treatment based on race, sex, color, ethnicity and national origin contained in any laws, executive orders, policies and rules issued by any state government agency or political subdivision in Missouri.
Preferential measures would be upon finding, supported by clear and convincing evidence that specific, pervasive and systematic discrimination has occurred in the past and will continue to occur in the future and if the measure is narrowly tailored to further a compelling governmental
interest.
Preferential measures would not be allowed for more than two years.
The proposal would allow preferences necessary to establish or continue eligibility for federal funds.
The proposal would allow any Missouri taxpayer to sue to enforce provisions of the proposal.
This legislation is not federally mandated, would not duplicate any other program and would not require additional capital improvements or rental space. This legislation would not affect Total State Revenue.
