FISCAL ANALYSIS

ASSUMPTION

Officials of the Department of Social Services, Office of the Attorney General, Office of Prosecution Services, Department of Mental Health, Department of Corrections, Missouri Sheriffs' Association and Missouri Police Chiefs' Association assume this proposal would have no fiscal impact to their agencies.

Officials of the State Courts Administrator (CTS) assume there would be one or more cases to define the parameters of the law. CTS officials would not expect a significant impact on the budget of the judiciary.

Officials of the Department of Public Safety - Missouri State Highway Patrol (MHP) assume

data is not currently available to estimate the number of juveniles that would fall within the bounds of this proposal and would be required to register with the Sex Offender Registry. Therefore, MHP officials assume they would request two additional AFIS entry operators to handle the workload created by this proposal. MHP staff assume one shared set of office equipment, expenses, and an AFIS workstation would be requested as the two FTE would work different shifts.

MHP officials indicated that the two AFIS Entry Operators would: verify fingerprints on registration cards; enter prints into AFIS, verify information on registration form for compliance with statutes; locate missing information to complete offender registration file information; enter information into Offender Registration File; maintain updates to the file, mail notices when offender moves to another jurisdiction, file Offender Registration Notification forms with the Offender Registration Forms, log and distribute Offender Registration Notification form to prosecutors for use as evidence in charges of failure to register as offender.

In the 1997 Juvenile Court Statistics Report, DOS had 521 referrals for sexual offenses and 440 referrals for sexual assaults, for a combined total of 961 in 1997. Because these are reported as "referrals" and not tracked on an individual offender basis, these numbers could reflect some of the same individuals with offenses in more than one county or the same individuals with more than one offense. Oversight assumes that by adding sexual offenders to the Offender Registration File, MHP would need one additional AFIS Entry Operator with associated equipment and expenses. Currently MHP already possesses AFIS workstations to maintain the Sex Offender Registry. Oversight assumes the new FTE could utilize one of the existing workstations. If, as a result of this proposal, the number of existing workstations are not sufficient to handle the additional workload, Oversight assumes MHP would request additional AFIS workstations through the normal budgetary process. Oversight assumes MHP's costs would come out of the Criminal Record System Fund.

DESCRIPTION

This proposal would require juveniles who have been adjudicated to have committed or attempted to committed certain acts to register with law enforcement.

This legislation is not federally mandated, would not duplicate any other program and would not require additional capital improvements or rental space.
