FISCAL ANALYSIS
ASSUMPTION
Officials from the Department of Agriculture, Department of Conservation, Tax Commission, Office of Administration - Division of Personnel, Department of Higher Education, Office of Prosecution Services, Department of Health, Lieutenant Governor's Office, Missouri House of Representatives, Department of Insurance, Department of Social Services, Department of Transportation, Veterans Commission, Department of Labor and Industrial Relations, Department of Economic Development, Department of Public Safety, State Courts Administrator, Department of Natural Resources, Attorney General's Office, Secretary of State's Office, Office of Lieutenant Governor, Department of Corrections and the State Public Defender assume this proposal would not fiscally impact their agencies.
In similar legislation introduced during the 1998 regular session, SB 520 (2389-01), the following agencies assumed the proposal would not fiscally impact their agencies: Department of Elementary and Secondary Education, Department of Mental Health, Gaming Commission, Department of Revenue, Lottery Commission, State Auditor's Office, Missouri Senate, Missouri Consolidated Health Care Plan, Office of the Governor, and the State Treasurer's Office.

No direct fiscal impact to small businesses would be expected as a result of this proposal.
DESCRIPTION
The proposal would allow former employers to release certain information pertaining to a former employee to a prospective employer. Unless the lack of good faith could be shown, the employer or designee releasing the information would be immune from civil liability.
This legislation is not federally mandated, would not duplicate any other program and would not require additional capital improvements or rental space.
