FISCAL ANALYSIS

ASSUMPTION

Officials from the Department of Transportation, Department of Insurance, Missouri Consolidated Health Care Plan, Department of Health, Department of Economic Development, Department of Labor, Department of Social Services, Department of Conservation, and Department of Public Safety, Missouri State Highway Patrol assume this proposal would not fiscally impact their agencies.

The Department of Mental Health (DMH) states that under current statute, there have not been any notable costs to the Department, so it is anticipated this proposal would have minimal fiscal impact on DMH.

The Department of Corrections (DOC) did not respond to our fiscal impact request. Based on their response to similar legislation during the 1997 session, Oversight assumes this proposal would not fiscally impact DOC.

FISCAL IMPACT - Small Business
No direct fiscal impact on small businesses would be expected as a result of this proposal.

DESCRIPTION

This legislation states that an entity contracting with a health professional cannot discipline or refuse to renew a contract because a health professional reported a violation of law or mismanagement to a governmental body. In an action under this act, a prevailing plaintiff may be awarded an amount at least equal to actual damages plus attorney fees, but not more than twice the amount of actual damages plus attorney fees.

This legislation is not federally mandated, would not duplicate any other program and would not require additional capital improvements or rental space.
