ASSUMPTION
Officials from the Office of State Courts Administrator assume that this proposal will not fiscally affect their agency.
Officials from the Office of State Public Defender, Department of Economic Development, Department of Mental Health, and Department of Health did not respond to our request for fiscal impact. However, for a similar proposal from this session these agencies assumed this proposal would not cause a fiscal impact.
Officials from the Office of Prosecution Services (OPS) did not respond to our request for fiscal impact. However, for a similar proposal from this session the OPS assumed this proposal may increase the caseload for some prosecutors; however, the fiscal impact should be minimal.
Officials from the Attorney General's Office (AGO) did not respond for our request for fiscal impact. However, for a similar proposal from this session the AGO assumed the costs associated with this proposal cannot be determined. Oversight assumes this proposal would not fiscally impact AGO.

DESCRIPTION
This proposal creates the crime of infanticide, defined as the knowing and intentional killing of a living, born infant; a partially born living infant; or a living infant aborted alive. This crime is classified as a Class A felony.
This legislation is not federally mandated, would not duplicate any other program and would not require additional capital improvements or rental space.
