No direct fiscal impact to small businesses would be expected as a result of this proposal.


DESCRIPTION

This proposal requires the licensure of persons dealing with lead-bearing substances. It requires that any person who engages in or conducts lead-bearing substance activities must complete a department or United States Environmental Protection Agency accredited training program and must be licensed by the Department of Health. The Department must develop updated lists

of all licensed persons who deal with lead-bearing substances and must make the lists available, free of charge.

The Department is allowed to restrict, revoke, suspend, or deny any license at any time if it suspects the terms and conditions of the license are being violated. An administrative

hearing may be requested to review the decision within thirty days of receiving notice. The Director of the Department may issue an immediate cease-work order to any person violating the

terms and conditions of licensure. Fees may be assessed for licenses and accreditation and they will be credited to the Missouri Public Health Services Fund.

This legislation is not federally mandated, would not duplicate any other program and would not require additional capital improvements or rental space.
