FISCAL ANALYSIS

ASSUMPTION

Office of State Courts Administrator (CTS) officials assume there would be no fiscal impact on the Courts.

The Taney County Clerk assumes that the County Clerk and Collector of Revenue would have some added duties. Officials were unable to determine if there would be fiscal impact.

Oversight assumes the commission retained by the Collector would be turned over to the County's General Revenue Fund and the amount would be sufficient to offset any expenses related to the collection of taxes for the Law Enforcement District.

Oversight assumes this proposal is permissive and would have no fiscal impact upon the state's counties. Counties where the voters would petition for establishment of a Law Enforcement District would have costs and income. Oversight will show fiscal impact to Local Governments as zero to a positive unknown. Oversight assumes that Law Enforcement Districts costs would not exceed income resulting with either zero fiscal impact or a positive unknown balance.

FISCAL IMPACT - Small Business
No direct fiscal impact to small businesses would be expected as a result of this proposal; however, should a small business be located within the boundaries of a district, that business would have additional property taxes to pay.

DESCRIPTION

This proposal creates the Missouri Law Enforcement District Act. A district may be created to fund, promote, plan, design, construct, improve, maintain, and operate one or more projects relating to law enforcement or to assist in related activity.

To create a district ten percent of the registered voters within the proposed district would file a petition in the Circuit Court of the county in which the district is located. Registered voters or people owning property within the proposed district could file a petition supporting or answer opposing the creation of the district.

The district would be funded by a voter approved property tax which could not exceed the annual rate of thirty cents on the hundred dollars assessed valuation. The county collector would collect the tax and remit the funds to the district's treasurer who would place the monies in the proper fund for law enforcement.

This legislation is not federally mandated, would not duplicate any other program and would not require additional capital improvements or rental space.
