FISCAL ANALYSIS
ASSUMPTION
Officials from the Office of State Courts Administrator (OSCA) stated any impact on the workload of the judiciary will depend upon the numbers of abuses which are prosecuted. The OSCA does not expect a significant increase in the number of criminal prosecutions.
Oversight assumes that any criminal prosecutions resulting from the enactment of this proposal could be handled by the courts with existing resources.
Officials from the Department of Public Safety - Missouri Highway Patrol assumes the ultimate need for additional manpower to regulate the illegal uses of legal gambling devices is unknown.
Oversight assumes additional officers would not be needed to enforce the provisions of this legislation.
Officials from the Missouri Gaming Commission, Office of Prosecution Services, and Office of State Public Defender assume that this proposal will not fiscally affect their agencies.
Officials from the Office of Attorney General did not respond to our request for fiscal impact. Oversight assumes this proposal would not fiscally impact their agency.

This proposal would affect small businesses who choose to use such gambling devices, as these businesses may realize revenue from them. | |||
DESCRIPTION
This proposal removes from the definitions of "gambling" and "gambling device" any game or amusement machine that gives only an immediate right of replay, noncash prizes, toys, novelties, coupons or tickets that can be redeemed for something of value, excluding cash, gift certificates, intoxicating beer or liquor, nonintoxicating beer or tobacco products. For purposes of the definition of "gambling", the something of value is limited to $300, as determined by the cost to the owner of manager of the premises.
For purposes of the definition of "gambling device", no corresponding monetary limit is established, and the amusement device cannot be identical in purpose to cash payout casino games.
This legislation is not federally mandated, would not duplicate any other program and would not require additional capital improvements or rental space.
